Welcome to afterglow (“we,” “us,” “our,” or the “App”). These Terms and Conditions (“Terms”) govern your access to and use of the App, our website, and related services (collectively, the “Services”). By creating an account or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
You must be at least 18 years old to create an account or use the Services. By using the Services, you represent and warrant that you are 18 years of age or older, that you have the legal capacity to enter into a binding contract, and that you are not barred from using the Services under the laws of India or any other applicable jurisdiction. We reserve the right to request proof of age or identity at any time and to suspend or terminate accounts of anyone we reasonably believe to be under 18 or to have misrepresented their identity.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You may not create an account on behalf of someone else, create more than one account for yourself without our permission, or use another person's photos, name, or identity.

We take reports of misconduct seriously. If a user is reported for behavior that may violate these Terms or applicable law, we reserve the right, at our sole discretion, to: (a) investigate the report, including by reviewing account activity, messages, and content submitted in connection with the report; (b) request additional information from the reported user or the reporting party; (c) suspend, restrict, or permanently terminate the reported user's account, with or without prior notice; (d) retain records of the report and our investigation for as long as reasonably necessary; and (e) where we reasonably believe that a report indicates a credible threat to safety, illegal activity, or a violation of applicable law, refer the matter to, cooperate with, and share relevant account information with law enforcement or other appropriate government or regulatory authorities, and comply with any valid legal process (such as a court order, summons, or lawful request) requiring us to do so.
Fine print: Creating an account is your acknowledgment that behaving badly toward another user has consequences. A credible report of harassment, threats, fraud, or other misconduct may result in account suspension or termination and, where warranted, referral to the police or other appropriate authorities — we are not obligated to warn you first, and we decide in our sole discretion whether a report meets that bar. We do not promise, and you should not expect, that we will contact your employer, family, or any other third party as a form of enforcement; our escalation path for serious or unlawful conduct is to the appropriate legal and regulatory authorities, not to your workplace.
We are not obligated to take any particular action in response to a report, to disclose the outcome of an investigation to the reporting party, or to provide reasons for any decision to suspend or terminate an account, except where required by applicable law.
We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice, including (without limitation) for violation of these Terms, at the request of law enforcement or a government authority, for extended inactivity, or if we discontinue the Services. You may delete your account at any time through the App settings. Sections of these Terms that by their nature should survive termination (including Sections 5, 8, 9, 10, and 12) will survive.
You retain ownership of the photos, messages, and other content you submit to the Services (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, and display that content solely for the purpose of operating, providing, and improving the Services. You are solely responsible for your User Content and represent that you have all rights necessary to share it and that it does not violate any law or any third party's rights.
afterglow does not conduct criminal background checks on users and cannot guarantee the identity, intentions, or conduct of any user, on or off the platform. You are solely responsible for your own safety when communicating with or meeting other users. We strongly recommend meeting in public places, telling a friend or family member of your plans, and using your own judgment before sharing personal information or meeting in person. We are not responsible for the conduct of any user, whether online or offline.
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. To the maximum extent permitted by law, afterglow, its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or in connection with your use of the Services or your interactions with other users, whether online or in person.
You agree to indemnify and hold harmless afterglow and its officers, employees, and affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, your violation of these Terms, or your violation of any rights of another person.
These Terms are governed by the laws of India, including (without limitation) the Information Technology Act, 2000 and the Consumer Protection Act, 2019, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights you may have, the courts at Bengaluru, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Your continued use of the Services after the changes take effect constitutes your acceptance of the updated Terms.
